  Course Description:Presents a one-semester course that provides a general overview of liability claims and claims handling. This course covers the legal relationships in liability claims under automobile, homeowners, and commercial liability insurance policies.

 STANDARD COMPETENCIES:
 
 I.      Identify and describe various types of liability claims, such as: auto liability, premises liability, product liability, professional liability, employer liability, directors and officers liability, personal and advertising liability, intellectual property rights claims, and environmental liability.
 II.     Describe the liability claim process.
 III.    Explain how to analyze liability coverage.
 IV.     Identify auto and homeowners insurance policy provisions that are complex or commonly subject to different legal interpretations.
 V.      Analyze coverage issues under liability policies to appropriately determine whether an individual is an insured under the policy, whether the damages are covered, and other coverage scenarios.
 VI.     Investigate coverage issues while protecting the insurer¿s rights.
 VII.    Draft an effective reservation of rights letter.
 VIII.   Identify and describe defenses to liability claims.
 IX.     Understand the fundamental concepts of tort law.
 X       Identify other bases of legal liability such as vicarious liability, liquor liability, bailment law, and the like.
 XI.     Understand how, when, and where to get the facts in any given liability claim. Identify the sources of information used in investigations, the rules of evidence related to those sources, and the practical considerations that are more efficient and effective in the liability investigation.
 XII.    Describe the objective and subjective factors that a claims representative should consider when evaluating the worth of a liability claim.
 XIII.   Identify effective ways to negotiate a liability claim settlement.
 XIV.    Explain how to effectively managing litigation expenses.
 XV.     Explain the general role of the claims representative in litigated cases and that of the defense and/or coverage counsel.
 XVI.    List the duties a landowner owes to a trespasser, a licensee, and a business invitee.
 XVII.   Identify the fundamentals of products liability laws and concepts and analyze situations in which the various laws and defenses might apply.
