Course Description: | Introduces the laws pertaining to secured transactions, letters of credit, and the bank collection process. Enables the student to explain the concept of negotiability, analyze the concept of holder-in-due-course status, define and explain the nature of the letter of credit, describe the nature of primary and secondary contractual liability on an instrument, identify the issues related to secured transactions and discuss the legal issues related to bank collections and check losses. |

STANDARD COMPETENCIES:
I. Understand the role of the bank regulatory agency, principal functions of commercial banks and the source of laws and regulations that regulate banks.
II. State the main objective and scope of important regulations.
III. Explain the essential differences among and the essential elements of negotiable and promissory instruments that banks deal with regularly i.e., drafts, checks, notes, and certificates of deposit.
IV. Describe the concept of and the rights of a holder in due course.
V. Describe the various contact liabilities and warranty liabilities of parties who issue or negotiate negotiable instruments.
VI. Describe the duties of banks in the check collection process.
VII. Describe the duties of banks and bank customers in the issuance, transfer, process and payment of checks.
VIII. Identify the most common types of ¿problem checks¿ and bank fraud that banks may encounter.
IX. Define the duties of banks in consumer lending transactions.
X Explain what securities interest are and how they are created, perfected and enforced.
